Ancestral Property Issue

Veena S asked 4 years ago
I have a query about my Ancestral Property Issue. We have our ancestral property currently some 3 -4 acres. And this was earned by our great great grandfather ie., my grandfather’s grandfather, this was actually over the years divided amongst their sons and eventually to my grandfather. My grandfather got his share of about/around 75 acres.  There are 9 children for my grandfather, 1 male(My father) and 8 females(my aunts)
During my grandfather’s lifetime, he enjoyed the property and also did all duties to his children, especially his daughters, and took care of them, post grandfather’s death my grandmother had done her to their daughters. All duties were done by selling property only. There is no property that neither my father earned nor my grandfather earned.

Grandmother’s death (2002) the certificate of the heir (varisu)

Now, after my grandmother’s death (2002) the certificate of the heir (varisu) is in the names of all my grandparent’s children(My father and 8 aunts).  So if my father wants to sell the property for his own daily needs/take care of family/children's education/daughter for marriage he has to get approval from all my aunts. As of today, currently, we are left with 3- 4 acres and to my father, we are 4 children(3 daughters and 1 son). I am the eldest, the second is my sister, the third is my brother and the fourth is my younger sister. In my father's stint, he had sold only 2.5 acres during my sister’s wedding(in 2010). So for my father to sell anything he had to get approval from my aunt to sell. Now we are 3 to get married, so for my father to sell property/take a loan to develop or dig borewell, or even to survey land we had to get approval from all my aunties.

ancestral occupation is agriculture due to monsoon failure/drought

Our ancestral occupation is agriculture due to monsoon failure/drought. We didn't have any cultivation for the past 20 years. We somehow managed to survive, studied after that myself, sister got a job we have taken care of the family for 15 years. During my stint working, I had never let my father sell any property as I have secured everything and also managed to clear all the family debts and also take care of my family's daily needs, my sisters and brother's education, and also family duties that have followed since long. Emotionally also I am so attached to the ancestral property that I always want to secure it.

Property transferred to my father by getting NOC from my aunts

In 2018, we thought to get the property transferred to my father by getting NOC from my aunts, but my aunties are now asking for money to give NOC, they quote the reason as they are in financial trouble, and they don’t have their own house or medical expenses, etc. All my aunties got married already and the last aunty who got married was in 1989 and the first aunty who got married was probably 1960 or 1961. My grandparents had to sell the property and religiously take care of all their daughters and their children and perform all their duties.[caption id="" align="alignnone" width="1200"]Ask your legal doubt of Ancestral Property Issue | Get the best advice and Consultation. I didn’t understand the reason why we should pay money or property to my aunties to give NOC. We are also born into the same family, and the property that we have currently is not something that my father or grandfather earned, it is what my great-great-grandfather earned(some 300 years ago). If someone is in need of a medical emergency or needs food definitely we are open to help but demanding money using this option of giving NOC is not justified according to me.
I need a solution to get out of these, we cannot go on this forever and this is creating too much trouble everywhere, and at the same time, I don't want to give money/property to my aunties. The property left for us is after everything my grandparents did for their daughters and now it is my father's turn to take care of his children just like how his father(my grandfather) did.Popular Questions - Ancestral Property Issue:http://103.133.215.241/lawyerchennai/legal-consultation/health-and-allied-insurance-company/http://103.133.215.241/lawyerchennai/legal-consultation/gratuity-case/http://103.133.215.241/lawyerchennai/legal-consultation/land-dispute-to-cancel-the-patta-and-registration-deed/
