There was a partition suit instituted wherein my grandmother was arrayed as defendant no. 5. The contesting defendant relied upon two wills to claim entire property. My grand mother did not file a Written Statement but instead filed a application for transposition as Plaintiff. The said Transposition application filed by grand mother came to be allowed. My grandmother did not file a memo adopting the pleadings of plaintiff no. 1. Neither did she file amended plaint making her own pleadings which in essence meant she did not have any pleadings. She deposed as PW. 1 and Plaintiff No. 1 deposed as PW. 2. The suit got decreed and allotted as follows

• 1/2 share to my grandmother,
• 1/4 to plaintiff no. 1,
• 1/4 to defendant no. 1,2,3.

The cross appeal preferred by the defendant no. 4 takes a ground that there is no independent pleadings of plaintiff no. 2 but as such there were pleadings of plaintiff no. 1, defendant no. 1, 2 and 3.This being my personal matter and I having heard immensely about the reliability of the Madras High Court judgments (Citation) more particularly in Civil law I am seeking your help.Kindly can you help me with a citation wherein a co-plaintiff Or a co-defendant if doesn't have independent claim then the court considering the other claims can decree the suit.
