I'm Manohar Palanisamy from Chennai. I initiated a Section 138 Matter for a Cheque bounce case two years ago, providing substantial evidence to support my claim. My lawyer is handling the case. Despite my confidence in the strength of my evidence, the opposing counsel frequently requests time extensions during each trial, causing significant delays. Surprisingly, my lawyer does not object to these requests. Additionally, he accommodates the accused party, which is frustrating. Consequently, this has caused further delays in the case. Therefore, I am growing increasingly frustrated with the situation.
Cheque bounce case: How i can handle Section 138 Matter?
My queries:
- Can we change the legal representation during the ongoing court proceedings?
- In the event that I am successful in a lawsuit, but the defendant fails to comply with the court's decision and does not pay the awarded amount, what are the potential consequences? Are there any alternative methods to recover the money?
