Need Divorce case advice
My husband and I were married in Chennai in January 2016 and we've decided on a divorce case now We live in the US, based on local Washington State laws, as we are residents for a year now, we are eligible to file a divorce case here The law states that all marital property is divided 50-50 regardless of any reasons if one of us is not responding/contesting But, my husband and I have decided to have the property settlement between ourselves so there's no contest/trial but mutual The court will approve of our mutual property settlement decision and provide a mutual consent divorce case adviceI consulted an attorney here on my rights and options. He mentioned that if its' mutual, then there's no need of an attorney as the parties can file the petition themselvesHowever, if the other party doesn't respond or wants to contest, the court will order a 50-50 split and provide the divorce order regardless of other party's consent
Not responding to my conversations on divorce
Both of us have an individual visa, car loans, savings, income, etc which we don't want to split 50-50. The only requirements I have from him are Payback my home down payment (50%), some money he owes me in household/down payment, and Marriage Expenses. Currently, he is not responding to my conversations on the divorce case. Therefore, I plan to file it myselfMeanwhile, my father demands the expenses he spent on our engagement/marriage. My husband orally argued that he cannot pay. I'm still going to try asking him on the property settlement agreement. Either to make him pay the marriage expenses to my dad or to protect my savings so I can pay my dad, the attorney advised me to have the below before I file a petition on my own:
- a) A demand letter from my father asking to return the marriage expenses due to divorce
- b) An Indian attorney's letter stating the fact that it's common/custom/any other reason in India to prove the validity of my father's letter
I need your help in helping me draft my father's letter and a letter from you validating it per Indian customs/law After the court approved divorce order, I need your help in transitioning this US divorce order to Indian divorce order to prove the validity
Divorce case advice on feasibility, process, and costs
Please let me know the Divorce Case advice feasibility, process, and costs for the above requests so we can move forward.Note: My father lives in India but he is visiting me in the US now and stuck here due to a travel ban. He will go back once the ban is lifted. The attorney advised to have a letter by an Indian attorney with strong verbiage, no loopholes and if possible, include laws/practices/community leaders' demands/customs/traditions with references and clarity. I’d also need a sample letter as my father writes to me with equally strong verbiage.
