We are EPC Contractors undertaking to pile and Fire Fighting works in various states of India. The sum of Rs.21 lakhs has to be received from one of our customers in Mumbai. This is for the past three years pertaining to the Mechanical contract works carried out by us in their project.Attorneys | Advocates | Lawyers in Chennai | Best Law Firms 24*7 | We are EPC Contractors undertaking to pile and Fire Fighting works in various states of India. The sum of Rs.21 lakhs has to be received from one of our customers in Mumbai. This is for the past three years pertaining to the Mechanical contract works carried out by us in their project.We approached MSME Arbitration Council and received a judgment in December 2016 by the MSME council as per MSME Act 2006 confirming the amount payable to us and directing the customer to settle the amount with interest. The customer then challenged the Arbitration order through a writ in Madras high court and got a stay. They have not paid the mandatory 75% deposit as required by the MSME act 2006 when filing the writ. We have filed a counter for this EPC Contractors Case.However, the EPC Contractors Case has not been taken up in the past one and a half years. We have had no opportunity to get the same dismissed. We have filed a case in NCLT in Mumbai. They require Madras High Court stay dismissal order to proceed further. Now, the task is to bring our case to the High court. The motive is to quash the stay order as early as possible. We are seeking the services of a high court lawyer practicing regularly in the High Court who could assist in an early resolution.We also have a similar case where the MSME council judgment is in favor of us but is going to further arbitration under Madras high court jurisdiction as per relevant arbitration laws.
