Legal share in my grandfather's land: My grandfather had some lands (8 acres). He had three children, my father, my uncle, and my aunt. my aunt married in ~1955 (grandfather bought 3 acres as a dowry from his savings). My grandfather died in ~1965 without a will. Patta of those lands was transferred to the male heirs (my father, my uncle) as joint holders. Few lands (2 acres) have no document at all, we have the only patta (EC has no record (1930-2021)).
process of partitioning with my uncle's heirs
Only my father and uncle's name were on it. As my father become old, through a settlement deed (Based on patta) he transferred his portion of lands (50%) to me (2019) based on patta. Now all the patta documents have my name and uncle's name. My uncle died in ~2010. We are in the process of partitioning with my uncle's heirs. Now the grandson of my aunt (who is died in ~1990) want share (1/3rd). My uncle's heirs are refusing this deal.Hindu Succession (Amendment) Act, 2005
Some say " As the pattas (public document) were transferred before Hindu Succession (Amendment) Act, 2005, legal heir of your aunt has no right over the property." We are ready to give compensation for the land. But he is asking 1/3rd of land.We are still negotiating, if the negotiation fails, is it possible to defend the case?
