Property Background: My inquiry is about a property dispute within a Muslim family. The properties in question were purchased by my grandmother.

Muslim Family Property Partition

My grandmother, who owns the property independently (not ancestral property), registered a half partition of the property in the name of her second wife's daughter and her husband, which was accepted by her son and signed accordingly.On the same registration papers, it was mentioned that the remaining half partition would go to her son after her death and should not be sold.

Current Situation

Both my grandmother and her son have passed away. Moreover, There is no will, agreement, or registration in the name of her son.However, the son of the fourth wife has occupied the entire property and filed a suit claiming that the property was orally gifted to him by his father. In fact, He has obtained an injection order.

Documents Submitted

The injection order was obtained based on the claim of an oral gift by his father, with no other documents submitted.

Current Status

The opposing lawyer has given a counter, and the case has been ongoing for almost 2 years.
