Query on state and district consumer forum proceedings

Filed a Case in district consumer forum

I have filed a case in the district consumer forum against alteration in the car parking plan by the builder. The court has asked the builder to revert back to the original car parking plan they published in their brochure (marketing material used by the builder to sell the apartment). Now that the builder had filed an appeal @ state consumer forum (Chennai) against the judgement given by the district consumer forum a few years ago. I appeared in person @ district consumer forum, now I did not attend any of the proceedings @ state consumer forum (Chennai).my Query is...

• will they dismiss the case as I did not appear @ state consumer forum

or

• will the judgement be based on the proofs provided by the builder, or would they still consider the district forums judgement and ask the builder to substantiate his claim by providing evidence?? any chance of judgement coming in my favour, despite not attending the proceedings??

or

• will there be any action/fine against me for not appearing in the state consumer forum?

or

• would I be able to hire a lawyer and compete for the proceeding from now on if I wish to do so now?? (it been more than 3 years since he appealed @ state consumer forum)
