The High Court observed that the provisions are ultra virus and violative of various articles of the
Indian constitution included article 14, 19(1)(g), 21, and 301
It has been observed that the said Act was contrary to the precedent laid down by the Supreme
Court. It was further argued that the state lacked legislative authority to pass the Act and for all
above the purpose honourable court struck down the provision which was ultra virus to the
constitution.
The Constitutional courts held it time to time that a game which involves skills are not included
under wagering agreement or betting therefore these are protected under article 19 of the Indian
Constitution.
